On November 18, 2024, the Federal Motor Carrier Safety Administration (FMCSA) will begin enforcing a new rule with severe implications for commercial drivers and the trucking industry. Truck drivers who are flagged in the FMCSA’s Drug and Alcohol Clearinghouse for drug or alcohol violations will not only be disqualified from safety-sensitive functions, but they will also “lose or be denied their State-issued commercial driving privileges.” This rule aims to ensure drivers who have failed to comply with the drug and alcohol program do not return to the road until they've completed the mandated return-to-duty process. The FMCSA, in collaboration with state DMVs, will be able to seamlessly enforce this restriction, making it impossible for drivers in violation to continue operating under the radar. |
