Mike, "Double Brokering" is broad term not defined by statute or regulation, but FMCSA is viewing it as "activites in which entities act as brokers without proper authority". This would be things such as a carrier taking loads and giving them out to other carriers or to brokers. Or brokers taking loads and representing to the customer that the loads would be only given to carriers. "Co-Brokering" defined as loads passed from Broker to Broker, is perfectly legal as long as the customer whose load is being dispatched is aware that the load may be dispatched to another broker. As a broker with dedicated carriers, we deal with this on a regular basis where Brokers who have loads cannot dispatch them to us due to restrictions placed on them by their customer.
